"The trial judge was unable to properly consider the defense's request that a significant portion, indeed most, of the allegations were not possible."

The Supreme Court said McCombs visited the operating rooms where the anesthesiologist was working to gain a better understanding of the arrangement before discovering that Doodnaught actually had access to carry out the attacks as alleged.

The appeals court also found that the judge looked closely at the evidence on whether patients could think about sexual experiences, noting that no witness had heard a case about multiple allegations of sexual abuse. .

"The opposition's contention is not rooted in any legal issue, so far as I can determine, but the fact that the trial judge," Judge David Watt wrote for the appeals court. "These factual findings were presented in connection with the defense that the conduct that each honestly believed occurred — and which constituted sexual assault — never occurred."
